Journii Terms & Conditions

Welcome to Journii ("Journii", "we", "our", "us"). These Terms and Conditions ("Terms") govern your access to and use of the Journii platform, including our website, mobile applications, and related services (collectively, the "Platform").

By accessing or using Journii, you agree to be bound by these Terms.

1. Nature of the Platform

Journii is a digital marketplace that connects travelers ("Users") with independent local tour guides ("Guides").

Journii:

• Does not provide tours or travel services directly
• Is not a tour operator, agent, or insurer
• Acts solely as an intermediary facilitating bookings and payments

All services are provided by independent Guides.

2. Eligibility

You must:

• Be at least 18 years old
• Have legal capacity to enter into binding agreements
• Provide accurate and complete information

Journii reserves the right to accept or reject any guide or guest from the platform, in its sole discretion, to protect the safety, trust, and quality of the Journii community. Approval of guide applications and continued participation are not guaranteed.

Journii may refuse or revoke access at any time for any lawful reason.

3. User Accounts

• You are responsible for your account credentials
• You must ensure your information is accurate and up to date
• Journii may suspend or terminate accounts for fraud, misuse, or breach of these Terms

4. Bookings & Payments

• Journii facilitates bookings between Users and Guides
• Payments may be processed through the platform ("Journii Wallet") or third-party providers
• Journii may charge service and/or commission fees

By confirming a booking:

• Users agree to pay the full amount
• Guides agree to deliver the service as described

Journii reserves the right to adjust pricing structures with notice and hold or delay payouts for risk, fraud, or dispute resolution.

5. Cancellations, Refunds & Chargebacks

• Each Guide sets their own cancellation policy
• Refunds are processed in accordance with the applicable policy
• Journii may intervene in disputes at its discretion

In case of chargebacks, Journii reserves the right to recover funds and may suspend accounts pending investigation.

6. Role & Responsibility of Guides

Guides are independent contractors solely responsible for:

• Delivering services as described
• Ensuring safety of participants
• Compliance with all applicable laws and licensing requirements
• Maintaining relevant insurance where applicable

Journii does not supervise or control Guides.

7. User Conduct & Acceptable Use

Users and Guides agree not to:

• Provide false or misleading information
• Circumvent the platform to avoid fees
• Engage in harassment, discrimination, or unsafe behavior
• Use the platform for unlawful purposes

Violation may result in immediate suspension or termination.

8. Off-Platform Transactions

Users and Guides may not solicit, arrange, or complete bookings outside of Journii to avoid fees.

Journii reserves the right to suspend accounts, recover lost fees, and restrict future access.

9. Trust, Verification & Content

Journii may verify identities, credentials, and licenses, and display ratings, reviews, and badges.

However, Journii does not guarantee the accuracy of user-generated content, and reviews reflect individual opinions.

10. Real-World Risk Acknowledgment

Users acknowledge that travel experiences involve inherent risks, including injury, illness, or loss.

By booking through Journii, Users voluntarily assume all risks and agree to follow Guide instructions.

11. Insurance

Journii does not provide insurance coverage.

Users and Guides are responsible for obtaining travel insurance and liability insurance (for Guides).

12. Platform Availability

Journii does not guarantee continuous or uninterrupted access or error-free operation.

The platform may be modified, suspended, or discontinued at any time.

13. Third-Party Services

Journii may rely on third-party providers for payments, hosting, and other services.

Journii is not responsible for third-party failures or external service disruptions.

14. Fees & Taxes

• All applicable fees will be disclosed before payment
• Users and Guides are responsible for any applicable taxes
• Journii may update fees with reasonable notice

15. Intellectual Property

All platform content, including branding, design, and software, is owned by Journii.

Users and Guides may not copy, distribute, or modify without prior written consent.

16. Data & Privacy

Use of the platform is governed by the Journii Privacy Policy (POPIA & GDPR compliant).

Journii may use anonymized, aggregated data for analytics, research, and platform improvement.

17. Limitation of Liability

To the maximum extent permitted by law, Journii shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or data
• Personal injury, death, or property damage arising from tours

Total liability shall not exceed the amount paid through the platform for the relevant booking.

18. Indemnification

Users and Guides agree to indemnify and hold Journii harmless from any claims, damages, liabilities, or expenses arising from use of the platform, breach of these Terms, or conduct during tours.

19. Termination

Journii may suspend or terminate access for breach of these Terms or for safety, legal, or reputational risks.

20. Changes to Terms

Journii may update these Terms at any time. Continued use of the platform constitutes acceptance of updated Terms.

21. Governing Law

These Terms are governed by the laws of South Africa.

22. Dispute Resolution

Disputes should first be addressed through good-faith negotiation.

If unresolved, disputes may be referred to mediation or arbitration in South Africa.
